Terms and conditions of participation and data protection for sweepstakes of Apollo Dion GmbH

2) Eligibility & Conditions of Participation

2.1 All natural persons who have reached the age of 16 are eligible to participate.

2.2 Employees, authorized representatives, legal successors and agents (i) of the organizer and (ii) of the natural or legal persons involved in the event and the implementation of a competition (e.g. advertising agencies) are excluded from participating in this competition. The same applies to their respective family and household members.

2.3 Participation in a competition is free of charge.

2.4 Participation in a competition is only possible within the respective participation period. Entries received after the closing date will not be taken into account in the draw.

2.5 Only one transmitted registration per participant takes part in a sweepstakes. It is expressly prohibited to use multiple email addresses or multiple profiles of a social media platform (e.g. Instagram) to increase the chances of winning within a competition. Participants with multiple registrations may be excluded from the competition by the organizer without further information and justification.

2.6 If a competition is linked to a task, its correct execution is a prerequisite for participation in the competition. Participants whose entries do not correctly fulfill the task may be excluded from the competition by the organizer without further information and justification.

2.7 Entries to a competition, in particular texts (statements of facts, comments, ...) and audiovisual (images, music, ...) may not contain any insulting or untrue content or violate copyrights and trademark rights. The organizer reserves the right, without further information and justification, (i) to delete such entries and (ii) to exclude the participant from the competition.

2.8 Participants in a competition are liable for their own entries.

2.9 The terms and conditions of the social media platforms shall also apply in their respective current version.

3) Determination and announcement of the winner(s)

3.1 The winner(s) will be determined after the closing date of a competition, unless otherwise stated in the competition announcement, by means of a random generator among all participants eligible to participate in accordance with section 2).

3.2 The winner(s) will be announced (i) by means of an individual e-mail to each of the winners (sweepstakes on website where e-mail is known) or (ii) by means of an individual address via the account(s) of the winner(s) on a social media platform, which winners must reply to within 3 working days via a direct message stating their full name (sweepstakes on social media platform). Without a substantively correct and timely response according to (ii), a claim to the prize will be forfeited and a new winner will be determined via the same procedure.

 
4) Presentation of winnings

4.1 The prizes offered in a prize draw shall be sent to the winner(s) by mail, delivery service or forwarding agent at the discretion of the organizer.

4.2 The prizes can only be shipped to a postal address in Germany, Austria or Switzerland. The costs of shipping shall be borne by the organizer.

4.3 Cash payment of the winnings is not possible.

5) Data protection

5.1 The address data required for sending prizes shall be stored and processed exclusively for this purpose. Participants have the right to information, modification, deletion and revocation of their data. Storage and/or forwarding for advertising purposes expressly does not take place.

5.2 The data protection declaration of the organizer applies in its current version.

6) Disturbances

6.1 The organizer reserves the right to change, adjust or prematurely terminate any competition if, in its view, there are circumstances that make this necessary.

6.2 Abuse or manipulation of a lottery is expressly prohibited.

6.3 The organizer is not liable for technical problems during a competition, in particular during the registration process or when notifying the winner(s).

7) Severability clause

7.1 Should any provision of these competition conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these competition conditions.

7.2 In a case pursuant to paragraph (1), the invalid provision shall be replaced by the legally permissible provision which comes closest in economic terms to the meaning and purpose expressed in the invalid provision.

7.3 The same shall apply in the event of a loophole in these terms and conditions.
